1. Scope and application
These terms and conditions apply to all sales of artworks by Pierrette Gonseth-Favre, independent artist.
Any order implies full and unconditional acceptance of these terms and conditions.
No amendment may be made to these terms and conditions without the prior written consent of the artist.
2. Artworks offered
All works presented are original and unique creations by Pierrette Gonseth-Favre.
Each work is accompanied by a certificate of authenticity signed by the artist.
Photographs of the works are non-contractual. Colour variations may appear depending on the screen used.
Dimensions given are indicative and may have a tolerance of 1 cm.
3. Prices and payment terms
Prices are expressed in euros, inclusive of all taxes.
Prices may be modified at any time; only the price in effect at the time of the order is binding.
Accepted payment methods:
- Bank transfer
- Cheque (Switzerland and France only)
- Cash upon personal handover
Full payment is required before shipment or handover of the work.
4. Order and confirmation
All orders must be confirmed in writing (email: pierrette@gonsethfavre.ch).
The artist reserves the right to accept or refuse any order.
An invoice will be issued for each confirmed sale.
The sale is only final after written confirmation from the artist and receipt of full payment.
5. Delivery and transport
Shipping and insurance costs are borne by the buyer.
Works are shipped in appropriate secure packaging.
Transport insurance is mandatory for all shipments.
Delivery times are given as an indication and are not contractual.
The artist cannot be held liable for delivery delays caused by the carrier.
Personal handover available by appointment in the Founex area.
6. Receipt and inspection
The buyer must inspect the condition of the work upon receipt.
Any deterioration or non-conformity must be reported within 48 hours of receipt.
After this period, the work will be considered compliant and in good condition.
In the event of damage during transport, the buyer must file a complaint with the carrier.
7. Right of withdrawal
In accordance with applicable legislation, the buyer has 14 calendar days from receipt to exercise their right of withdrawal.
The work must be returned in its original condition with:
- Its original packaging
- Its certificate of authenticity
- Its invoice
Return costs are borne by the buyer.
The refund will be made within 14 days of receipt of the work in good condition.
8. Warranties
The artist guarantees the authenticity of her works.
Works are sold as-is, with any imperfections that are part of the artisanal character of the creation.
No warranty is given on the conservation of the work, which depends on the storage conditions chosen by the buyer.
9. Intellectual property and copyright
The buyer becomes the owner of the physical work but not of the copyright.
The artist retains all moral and economic rights over her creations.
Any reproduction, even partial, is prohibited without the written authorisation of the artist.
Commercial use of the image of the work is strictly prohibited.
The buyer agrees to mention the name of the artist at any public presentation of the work.
10. Resale and droit de suite
In the event of resale of the work, the artist must be informed by the buyer.
The droit de suite may apply in accordance with applicable legislation.
The buyer agrees to pass on the certificate of authenticity to the new owner.
11. Liability
The artist's liability is limited to the sale price of the work.
The artist cannot be held liable for indirect damages or loss of value of the work.
The buyer is solely responsible for insurance and conservation of the work after delivery.
12. Force majeure
The artist cannot be held liable for non-performance of her obligations in the event of force majeure.
Force majeure includes all unforeseeable, unavoidable events beyond the control of the parties.
13. Personal data
Data collected is used solely for order management and customer relations.
It is never transmitted to third parties.
The buyer has the right to access, rectify and delete their data.
14. Applicable law and dispute resolution
These terms and conditions are governed by Swiss law.
In the event of a dispute, the parties will endeavour to find an amicable solution.
Failing that, the courts of the Canton of Vaud shall have exclusive jurisdiction.
15. Final provisions
If any clause of these terms and conditions is declared null and void, the remaining clauses shall remain applicable.
The artist reserves the right to modify these terms and conditions at any time.
Amendments shall take effect upon their publication on the site.
